MIG for non-res care

My client is 83 and gets care at home. Her financial assessment includes MIG of £189 but as she gets AA shouldn’t it also include the disability premium for a single person: £40.35?

We believe this to be the case but many LA’s don’t agree. See section 4.4 of our factsheet Paying for care and support at home

I’ve attached a paper which sets out why we think this is correct - when we’ve discussed this with social care professionals. their response has been along the lines of ” But the rules aren’t meant to allow that to happen” but that’s a very different thing from what the regulations actually appear to allow.
