-Clarification on Rule 18 of CCS Conduct Rules – whether prior permission is a must for purchase of movable property? • Ministry of Law & Justice vide its circular dated 19.6.2024 clarified on the ruling position of Rule 18 ie. about the purchase of movable and immovable properties. • As per Sub rule (2) of Rule 18, all Government servants to make a report to the prescribed authority before entering into any transaction of immovable property in their own name or in the name of the members of family. • If such transaction with a person having official dealings, prior sanction is required from the authority for such transaction. • Sub Rule (3) provides that entering into any transaction of movable property intimation should be given within one month. If exceeds the monetary limits prescribed of entering to transaction of such movable property/ • If it is with a person having official dealings prior sanction of the authority should be obtained. • Prior intimation is sufficient for entering in to transaction of immovable property and in many places they are in confusion with prior permission and it is also being refused in one case of West Bengal Circle.
