-RTP service for all benefits – Hyderabad CAT order’s implementation being delayed
• Around 300 former RTPs of AP & Telangana circles had filed OAs in Hyderabad CAT during 2012 -13 challenging the Directorate orders issued during 2012 denying the service benefits to erstwhile RTPs.
• The Honble CAT allowed the OA. and directed to extend not only the back wages but also the service for all purposes.
• Likewise, six to seven CATs have given favourable judgments in the case of erstwhile RTPs. Two times Supreme Court dismissed SLPs and the applicants were granted the benefits instead of all in those cases.
• The Department filed writ petition in Hyderabad High Court in WP No. 17400/2016 17425/2016 challenging the CAT directions during 2016. The writ petition was dismissed on 27.2.2023.
• The Department filed SLP in the Apex Court in Jan 2024 challenging the High Court orders.

• Meanwhile the contempt petition filed was heard by High Court on 9.2.2024 and the bench has ordered to implement the Supreme Court direction within four weeks that is by 8th March 2024.
• It is dismayed that the Court case filed by the P3 & R3 CHQ during 2014 in the principle CAT Delhi is yet to be heard.
• The advocate of the union case should take sincere endeavour to implement the CAT Hyderabad judgment to all the similar erstwhile RTPs. It should be implemented to all including the applicants of this case. Kudos to the comrades who are fighting legally very effectively in RTP case over decades.
