-Notional Increment to June 30 retirees – Present position • • On 26.6.2023, the DOPT informed that the issue is under examination in consultation with the Department of Expenditure. On completion of process action will be taken. • In the meantime, the Comptroller and Auditor General of India issued orders on 13.6.2023 allowing the benefits only to the pensioners who are party to the cases. • Subsequently on 18.1.2024, the Comptroller of Auditor General of India extends the benefits to all those employees retiring on 30th June or 31st December with effect from 30.6.2023 only. • The Railway Board on 10.7.2023 directed its units not to challenge similar cases further since it will be futile exercise after 19.5.2023 judgment. Only time can be sought for compliance of orders. The Ministry is persistently following up with DOPT. • Ministry of Defence also forwarded the representation for consideration by DOPT on 21.6.2023. • DOPT vide its letter dated 6.7.2023 informed about the extension of judgment to the similarly placed Non petitioner employees under examination in consultation with DOE. • DOPT vide its letter dated 6.11.2023, directed to take administrative decision on complying with the court orders on the subject matter. • Based on the above, the Ministry of Mines vide its letter dated 29.12.2023 directed to consider the post receipt of applications as per the Supreme Court order dated 11.4.2023. • The Department of Posts vide its letter dated 12.10.2023 directed the Chief PMG Tamilnadu circle to challenge the fresh petitions. • In the Standing Committee meeting held on 15.12.2023, the Staff side protested against the undue delay. The Additional Secretary informed that the issue is in an advanced stage of consideration and the DOPT would take a decision in this regard very soon. • The DOPT vide its note dated 15.1.2024 suggested the Ministry of Defence that since the consultation to resolve the issues is underway and likely to take some time, the department may take cognizance of the position and prepare suitable counter. • The Dept of Posts vide its letter dated 31.1.2o24 approved the cases of 16 individuals and directed to implement the same. • Ministry of Information & Technology vide its letter dated 12.2.2024 extended this benefit to two officials and also extended the benefits to all the similarly situated employees in their department based on the guidelines of DOPT. • The CPWD department vide its letter dated 20.2.2024 extended the benefits to the officials who have approached the court. There is no mention about the implementation of the same to the similarly situated officials. • The Railway Board vide its letter dated ..2.2024 directed to extend the benefit of notional increment only to the contempt cases. After getting guidelines from DOPT the remaining will be dealt. • In the recent SCOVA meeting held on 22.2.2024, it was replied after mentioning the court orders that there was no reference to the relevant Fundamental Rules governing the annual increment. This was examined and Ld Attorney General was consulted . In pursuance thereof efforts are being made to seek clarification from the Honble Supreme Court on the relevant issues including rule provisions which need elucidation. Action to implement the Supreme Court orders can be taken on the completion of the said exercise. • Some pensioner association informed that we have no alternative and directed the pensioners to file cases separately. • Many state Governments viz. Tamilnadu, Andhra, Maharashtra, Chattisgarh etc issued orders granting notional increment to its employees. Asking the individuals to challenge in court in such matter is shameful. • The intention of the Govt is well very known. It wants to drag on the issue by seeking clarification from the Supreme Court about the changes required in the Fundamental Rules. It can be done by the Govt itself. • We should mount pressure to the Govt. It is not the case of pensioners alone and it is related to serving employees. Around 10% of the pensioners and serving employees will be benefitted. The JCM Staff side should exert more pressure on Govt. • According to me they can delay but could not deny.
