NEW DELHI: Observing that there has been a recent tendency to misuse the machinery of criminal justice by lodging false and frivolous cases,
SC has said that judiciary should be vigilant not to allow such proceedings, which must be nipped in the bud, reports

A bench of Justices B V Nagarathna and Augustine George Masih said that the criminal process must not be allowed to be utilised for any oblique purpose and FIR should be quashed if the offence is not prima facie established and chances of a conviction ultimately are bleak
Court quashed the criminal proceedings against the principal of the Bishop Johnson School and College in Lucknow against whom FIR was lodged in 2017 and a chargesheet filed for allegedly embezzling fees paid by students.
“We find that in recent years the machinery of criminal justice is being misused by certain persons for their vested interests and for achieving their oblique motives and agenda. Courts have therefore to be vigilant against such tendencies and ensure that acts of omission and commission having an adverse impact on the fabric of our society must be nipped in the bud,” the bench said.
