Taking up woman’s plea, Supreme Court to probe lover’s ‘detention’
NEW DELHI: The Supreme Court on Monday entertained a plea of a 23-year-old woman seeking to reunite with her 21-year-old woman lover, who has allegedly been illegally detained by her Kollam-based parents and is not being allowed to be with thepetitioner.
A bench headed by CJI DY Chandrachud, who was part of the five-judge bench that had in 2018 decriminalised Section 377 of the IPC to legalise consensual sexual relationship in private between adults of LGBTQ community members in Navtej Singh Johar judgment, entertained the 23-year-old’s petition challenging a Kerala HC decision to direct counselling for her lover after the latter purportedly conveyed that she was not in illegal detention by her parents.

The petitioner’s counsel said the report about absence of illegal detention was conveyed to HCthrough the secretary of district legal services authority of Kollam, who was deputed for interviewing the 21-year-old at her parents’ place. The counsel wanted an independent assessment of her views.
CJI Chandrachud, who also heads the apex court’s e-Committee, deputed a woman judicial member of the Committee to coordinate with the Kollam family court presiding officer and interview the 21-year-old to find out whether she was staying with her parents of her own volition or there was any coercion in confining her to the parental home.
The bench, also comprising Justices P S Narasimha and J B Pardiwala, requested the two women judicial officers to ensure that the 21-year-old was interviewed in a free and fair manner without there being any influence from her parents. “A report containing her statement would be filed before the SC on or before February 17,” it said.
