Haridwar hate speech: Supreme Court lets Tyagi out on bail but gags him
NEW DELHI: The Supreme Court has granted bail to Jitender Narayan Tyagi, aka Wasim Rizvi, in the Haridwar Dharam Sansad hate speech case but restrained him from speaking to TV channels and going active on social media, either directly or indirectly.
After hearing senior advocate Sidharth Luthra for the accused, a bench of Justices Ajay Rastogi and BV Nagarathna said Rizvi, who converted to Hinduism in December last year and took the name Jiender Naryan Tyagi, has made out a case for grant of regular bail as co-accused have been granted bail and the chargesheet in the case has been filed by police on March6.

It also noted the trial court at Haridwar framed charges against him on May 19. Without going into the merits of the case, the bench agreed to grant him bail, butsaid, “. . . looking to the alleged allegations against the petitioner, we consider it appropriate to observe that he shall furnish an undertaking before the trial court, in addition, to the terms and conditions imposed by the trial court for ensuring his presence and participation in the trial, that he will not address electronic media or social media and shall not indulge into such alleged activities any more, directly or indirectly. ”
The SC directed Haridwar police to produce Tyagi, who had surrendered on September 2, before the trial court within three days. It said he “shall be released on post-arrest bail subject to such terms and conditions to the satisfaction of trial court and on furnishing undertaking in above terms before the trial court”.
The bench warned Tyagi that violation or breach of bail conditions would entitle police and complainants to move for cancellation of his bail.
