SC sets aside Madras HC verdict on EWS quota in medical education
NEW DELHI: The Supreme Court has set aside the Madras High Court's direction to Centre to seek SC's approval before implementing economically weaker sections (EWS) quota in medical education.
However the apex court made it clear that it is not quashing HC's direction on merit but on the ground that HC should not have passed the order while deciding a contempt petition.
The Madras high court had last month disallowed 10% quota for EWS among forward castes in MBBS admissions under All India Quota (AIQ), saying it would take the total reservation beyond the Supreme Court-mandated cap of 50%.

‘The additional reservation provided for EWS in the notification of July 29 cannot be permitted except with the approval of the Supreme Court,” the court had said.
It also held that OBC quota for AIQ seats will be 27% as notified by the Union government, and not 50% as demanded by the DMK in its contempt petition.
“It is inconceivable that all states having government-run medical colleges would give up a percentage of seats to AIQ but would retain the right to enforce reservation in such quota as per the state norms,” the Madras High Court had said.
