Pensioner HB after April 19

Hi All

Got yet another mixed age couple scenario. Couple were getting ir-ESA plus occ pen and state pension and c-ESA. Older member of the couple is 69 and therefore have not aged into scenario. ESA ended due to Industrial Injuries being paid to them.

This now means they get Pensioner HB. I haven’t crunched the numbers but might this mean they could claim PC? Or not because the HB change didn’t apply until after APril 19.

Edit - HB has not ended which I believe is correct as it’s a simple change in income

Unfortunately they can’t claim PC.

See Art. 2(3) and Art. 4 here.

EDIT: In fact, HB should have ended under Art. 6(2)(b) of that Order.

Oh no. Thanks Charles. And that’s because they can’t be granted pensioner HB beyond April ‘19 so it has to end?

It’s because their HB migrated from the working age HB Regs to the SPC age HB Regs when the IIDB took their income over scale for ESA(ir): this is one of the specified events in Article 6 that causes HB to terminate
