I have a case scored no points for care and the very nice HCP has stated all through that to need help someone needs to be there and as she is on her own and managing she scores zero,
now normally I would just write up how it is not what she has but what she needs reply, point of my post is, does anyone know of a case law that could be quoted or any other help that I could use,

I wouldn’t get too bogged down with the HCP’s faulty logic.

The issue you have to put before the tribunal is that your client either doesn’t manage on her own, can’t do it safely, in an acceptable manner etc, or can’t do it the majority of the time. (ref regs 4 and 7)

My line to clients is to largely forget the HCPs report. Focus on the strengths of your evidence rather than the weaknesses of theirs.
