SPIRIT OF THE EAGLE RIDEAWAY

Moto Guzzi USA launched the “Spirit of the Eagle” contest online earlier this year, while many were at home daydreaming of the next time they would get to ride. Now, the contest has completed, three winners were selected to experience the ride of their dreams, with accommodations from Moto Guzzi.

The first winner to partake in their adventure was Mr. Kevin and Mrs. Beth Young. When first speaking with Kevin he expressed his excitement for the trip as it was “such great news, since this year has not been great for anyone”. Specifically, Kevin had been struggling with the crisis earlier in the year and choose to inform his Instagram fan base that unfortunately he will be taking some time off and possibly not returning to social media. Luckily Moto Guzzi was able to brighten up his year and give him the opportunity to partake in the trip of a lifetime.

Kevin immediately started to plan out his trip to visit some of the most beautiful and iconic locations around the US. His original plan included starting in Fort Collins Colorado and working his way to Breckinridge, Aspen, Million Dollar Highway, Durango, Monument Valley and Moab, Utah. He wanted to be able to test the new Moto Guzzi V85 TT Travel in a range of different elements and terrain while enjoying a week away from being locked in doors.

While speaking with Kevin about his trip and ironing out the details we were able to build a unique relationship with him speaking about his struggles, his experience professionally, his previous motorcycle adventures, his knowledge of the motorcycle business and his pure passion for motorcycling.

This was the true essence of “The Spirit of the Eagle Rideaway”. We wanted to provide the opportunity for individuals to take a step away from their current responsibilities of life, especially with all of the difficulties surrounding the current crisis, to enjoy the open road, explore new regions and live life freely again. As part of our commitment to all the winners, we supplied Kevin with the brand new V85 TT Travel. You may be wondering what the differences between the V85 TT Adventure and the V85 TT Travel are, and why we choose to provide the Travel edition. The new V85 TT Travel is equipped with additional features such as heated hand grips, auxiliary lights, travel side cases, a new desert themed paint job and a taller windscreen, appropriate for long distance travels, like this one celebrated by Kevin and Beth. In combination, all additional features allow the rider to feel more comfortable and at ease along their journey. Since Kevin and Beth were traveling two-up, we also fitted the bike with the top box featured on the V85 TT Adventure model, to make storage a breeze.

Along his journey Kevin was able to see how well the V85 TT Travel lived up to its name. On September 9th Kevin posted on his Instagram (@2uptogether), a picture of him and his wife standing with the V85 TT Travel between a gorgeous red rock mountain range. At this point in his travel he has had the V85 for a few days and truly was getting the feel of what the machine had to offer. “Wow! Right outside of Moab is Highway 128 that hugs the Colorado River. It is an A+ motorcycle road. We ripped around it most of the day. The bike felt more like the 1200cc I am accustomed too without all of our stuff weighing it down. Being down in the canyon without all of the wind noise I could hear the v-twin engine sing. I admit I like the sound. It sounds like a motorcycle should sound. The rumble is unmistakable v-twin at low speeds and it purrs at high speed. Now that I am used to the gearbox and throttle, I has a ball riding those curves. The gearbox is smooth and shifts effortlessly. The bike handles great. It turns in easy and tracks so well.” Even with the unexpected, harsh weather conditions thrown at them they truly enjoyed their trip!

Moto Guzzi USA is excited to announce the “Spirit of the Eagle” Rideaway – an exclusive opportunity to plan your dream trip around the USA for two weeks, with a V85 TT supplied by Moto Guzzi USA.

We are offering the opportunity to plan up to a two-week trip in the month of August 2020 anywhere in the US on the V85 TT. You pick your destinations and time frame to get there, while we support with the mode of transportation, gas and the cost of hotels. It’s the perfect chance to get familiar with the new adventure model, test its capabilities and visit your favorite destinations.

Two Winners will win an exclusive opportunity to plan a motorbike trip around the USA with a MOTO GUZZI V85TT.

SPONSOR: Piaggio Group Americas, Inc., 257 Park Avenue South, 4th Floor, New York, NY 10010 (hereinafter “PIAGGIO GROUP AMERICAS” or “Sponsor”).

ELIGIBILITY: Contest is open only to legal residents of the fifty (50) United States, District of Columbia, Canada (excluding Quebec) who are: at least twenty-one (21) years of age at the time of entry and hold a valid U.S. or Canada Motorcycle License (unexpired and valid to ride a Moto Guzzi V85TT in the U.S.). Entrants must be the rightful owner (or have authorized use of) of the email address identified on the entry form.

Employees and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or those living in the same household (whether or not related) of PIAGGIO GROUP AMERICAS, and their respective parents, affiliates, subsidiaries, prize suppliers, distributors and advertising and promotion agencies (collectively, Parties”) are not eligible to enter or win. CONTEST OBJECTIVE: The Moto Guzzi “Spirit of the Eagle” Rideaway is a contest to celebrate motorbike adventures across the USA. Entrants must submit photos and/or videos of their previous motor bike road trips to participate in the Contest. To enter, visit the website at https://motoguzzi.regfox.com/spirit-of-the-eagle-rideaway (the “Website”), complete the registration process on the Contest site with the information requested and follow the online instructions to upload and submit your video or photos (the “Submission”) directly to the Website. Each Submission entered into the Contest must meet the following “Submission Requirements” (any submission that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):

(a) any video must be no larger than 1GB;
(b) any video or photo must be the Entrant’s original, previously unpublished work and must not infringe a third party’s copyright or trademarks, privacy, or other intellectual property rights;
(c) the Entrant should be able to provide on request all appropriate clearances, permissions and releases for the Submission, including location releases for all recognizable locations and releases from all identifiable individuals appearing in the video (in the event an entrant cannot provide all required releases, Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Sponsor’s benefit, or allow the applicable Submission to remain in Contest);
(d) the Submission must NOT contain material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent (e.g., relating to murder, the sales or use of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing or which is otherwise inappropriate, in the sole discretion of the Sponsor, nor may Submission contain any derogatory references to Sponsor or any other person or entity including brands or trademarks of any Sponsor or any other person or entity; and

(g) any Submission that does not meet the above criteria for any reason, may be resubmitted as long as it is resubmitted before the Entry Period deadline.
Limit one (1) entry per Entrant. Submissions must be received by the end of the Entry Period to be eligible for the Contest. No substitutions of Submissions with new versions will be accepted under any circumstances once the original Submission is submitted for consideration.

Submissions which violate any of these requirements will be deemed ineligible to be included in the Contest and the Submission will be disqualified at the Sponsor’s sole discretion. For purposes of these Official Rules, “receipt” of Entry occurs when Sponsor’s servers record the Entry information resulting from Entrant’s entry being received in the Entry Form on the Website. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules.

JUDGING: Sponsor’s representatives (the “Judges”) will review the verified Entrants’ Submissions and select two prize winning Submissions from among all eligible Entrants’ Submissions using the following judging criteria: creative content, support of brand image, cleverness, wittiness, and humor. Social media popularity, in the form of followers and/or likes, may also be considered in the judging. The two top scoring Entry will be declared the Contest winners (“Winners”). Sponsor’s decisions will be final and binding and not subject to challenge or appeal on eligibility determinations and all other matters relating to this Contest. Winner selection will be subject to Sponsor’s verification of Winners’ eligibility. Winners will be notified by telephone, email and/or regular mail using contact information provided at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If any potential winner does not respond within the time required by Sponsor, or if any winner notification is returned as unclaimed or undelivered to a potential winner, such potential winner will forfeit his/her prize and an alternate winner may be selected based on the results of the aforementioned judging criteria. If any potential winner is found to be ineligible or if he/she has not complied with these Official Rules or declines the prize for any reason, such potential winner will be disqualified, and the prize may be awarded to an alternate winner based on the results of the aforementioned judging criteria. Sponsor reserves the right to disqualify any Entry for any reason, in its sole and absolute discretion. Winners will be selected by Friday August 7, 2020.

PRIZE: There are two (2) prizes available to be won by two (2) Winners. The prize consists of a travel package for one person within the continental United States and the free use of a Moto Guzzi V85TT (the “Prize” or collectively the “Prizes”) according to the approved trip plan. Sponsor estimates that the Prize trip shall last between three to four consecutive days depending on the destination selected by Winner, but in no event shall Winner have use of the Moto Guzzi V85TT for more than fourteen consecutive days. The Prize has a total value of up to USD 2,500.00 (two thousand five hundred/00 U.S. dollars). Winners may select their preferred destination(s) among a list of available destinations submitted by Sponsor. Once the Winner(s) is/are verified they will have to submit a trip plan through email at [email protected] for Sponsor’s approval. Upon approval Sponsor will schedule hotels, flights, and logistics in coordination with Winners within the $2,500.00 budget allotted for the Prize. Sponsor will notify Winners of the dealer location where to pick up the Moto Guzzi V85TT. The Sponsor will choose the dealer closest to Winner’s residence, and subject to availability of the Moto Guzzi V855TT (the “Dealer”). Winner will have to complete and sign all forms, documents and releases necessary to receive possession of the Moto Guzzi V85TT from the Dealer on a temporary basis. Sponsor will provide insurance coverage for the winner according to its established practices and pursuant to the law of the state where the Dealer is located. All fines, penalties, traffic and/or parking violations, court costs, towing charges and other expenses relating to the Moto Guzzi V85TT in possession of Winner(s) during the trip shall be the exclusive responsibility of the Winner(s). Travel must be completed within 1 month of notification of win.

WINNER NOTIFICATION: Winner(s) will be determined after the Contest’s end date and will be notified by phone and email. Winner(s) will be required to provide mailing address which will be used for all official notifications regarding the Prize. In the event it is determined that the Winner has not complied with these Official Rules, has failed to execute and return any required documents within the specified time period, has made false statements or a prize notification is returned as undeliverable, then the Winner will be disqualified and at Sponsor’s sole discretion, the Entry with the next highest score may then be declared the alternate Winner.

PRIZE & APPROXIMATE RETAIL VALUE (“ARV”): A TRIP VALUED AT TWO THOUSAND FIVE HUNDRED USD (USD 2,500). Limit one Prize per person. The prize does not cover expenses for guests of the Winners. In case a Winner chooses to bring a guest or guests, the Winner shall be solely responsible for all expenses incurred by said guest(s). Winner is solely responsible for all expenses, costs or fees associated with transportation and acceptance and/or use of the prize not expressly specified herein as being awarded, including without limitation, any and all taxes (if any). Winner(s) is not a recipient of a prize until she/he has been verified as the Winner(s) by the Sponsor.

The Sponsor reserves the right to, at its sole discretion, to reschedule the Contest, modalities of entry and/or end dates, cancel the Contest, or cancel the awarding of Prizes. Prize(s) are not redeemable for cash.

No transfer, substitution or cash equivalent permitted by Winner(s). A winner is responsible for paying any costs and expenses not expressly specified herein. Sponsor reserves the right to substitute a Prize (or component thereof) with another prize (or component thereof) of equal or greater value if the Prize is not available for any reason, as determined by Sponsor in its sole discretion. By entering this Contest and accepting the Prize, the Winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest- or prize-related activity. The Winner(s) understands and agrees that Sponsor or Prize providers have the right, in their sole discretion, to disqualify and remove the Winner(s) from any activity at any time if the Winner’s behavior at any point is uncooperative, disruptive, may or does cause damage to person, property, or the reputation of Sponsor or otherwise violates the policies of the Prize providers such as hotels, airlines, etc., and in such a case, the Winner(s) will still be solely responsible for all taxes and other expenses related to the Prize. All Prize details are at Sponsor’s discretion and may change at any time without need for further notification.

The Winner shall be solely responsible for any required or applicable federal, state, provincial and/or local taxes and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. For residents of the U.S. only: All U.S. Winners must provide Sponsor with a valid social security number for tax reporting purposes. The Winner will receive an IRS Form 1099 from the Contest Entities for the actual retail value of the Prize for the calendar year in which the Prize was fulfilled.

To obtain the Winners’ names or a copy of these Official Rules, send a request along with a stamped, self-addressed envelope to “Piaggio Group Americas, Inc.” Winner /Rules, 257 Park Avenue South, 4th Floor, New York, NY 10010. Requests for the name of the winner must be received no later than Monday, August 31st 2020.

If a potential Winner: (i) cannot be contacted; (ii) does not respond within two (2) days from the date the Sponsor first tries to notify him/her; and/or (iii) the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the Contest or receive the Prize, and an alternate potential winner may be selected. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Contest, such individual will be declared the “Winner” of the Contest.

If Winner(s) is unable or unwilling to accept the Prize and/or is unable or unwilling to travel to the experience location(s) as planned and agreed with Sponsor they will forfeit the prize. Winner(s) must give advanced prior notice to Sponsor at least 15 (fifteen) days prior the planned departure. Failure to give advanced prior notice to Sponsor as detailed above will expose Winner(s) to compensate Sponsor for the expenses that Piaggio Group Americas, Inc. incurred for the trip preparation & for the logistics process in organizing the trip for Winner(s). The total amount that will be charged to Winner(s) that will forfeit the prize as outlined above, is a sum up to USD 2,500 (USD two thousand five hundred/00).

GENERAL CONDITIONS: Winning constitutes permission (except where prohibited by law) to use Winner’s name, images, hometown, likeness, prize won, and photograph (all at Sponsor’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification or permission. Contest Parties and their respective officers, directors, agents, representatives, and employees (collectively, “Released Parties”) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed Entries; all of which will be void. Released Parties are also not responsible for problems related to technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Entry to be received by Sponsor on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled, or misdirected communications which may limit a Entrant’s ability to participate in this Contest. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Contest, including, without limitation, errors or malfunctions with may occur in connection with the administration of the Contest, the processing or judging of Entries, the announcement of the prize or in any Contest-related materials. Mass entries generated by a script, macro or use of automated devices will be disqualified. Sponsor reserves the right to modify, suspend or terminate the Contest in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest and, if terminated, at Sponsor’s discretion, determine the Winner(s) using all non-suspect, eligible entries received up to time of cancellation using the judging procedure outlined above. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of Entry will be deemed to be the Entrant and must comply with these Official Rules. Authorized subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses. Sponsor reserves the right at its sole discretion to disqualify any individual (and void his/her Entries) it finds to be tampering with the Entry process or the operation of this Contest or website, intending to annoy, abuse, threaten or harass any other Entrant, Sponsor, or any of its representatives or to otherwise be acting in violation of these Official Rules. CAUTION: Any attempt by a Entrant to deliberately damage any website or undermine the legitimate operations of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such Entrant to the fullest extent permitted by the law and to disqualify such Entrant from the Contest.

ASSIGNMENT OF RIGHTS: Entrant hereby acknowledges that Entry and all other materials of every kind whatsoever created by Entrant relating to the Contest (collectively, the “Work”) are a “work made for hire” (as that term is used in the United States Copyright Act) for Sponsor, and assigns to Sponsor (or, if any applicable law prohibits or restricts such assignment, Entrant hereby grants to Sponsor an irrevocable, perpetual, royalty-free, transferable license of) limited right, title and interest in and to such Work, including, without limitation, all rights of every kind and nature (whether now known or hereafter devised, including all copyrights therein and thereto and all renewals and extensions thereof), throughout the universe, in perpetuity, for all purposes, in any and all media, whether now known or hereafter devised. By submitting an Entry, Entrant acknowledges and agrees that Sponsor may obtain many submissions under this Contest and that such entries may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other contests staged and/or sponsored by the Sponsor, and waive any and all claims Entrant may have had, may have, and/or may have in the future, that any composition, design, video and/or other works accepted, reviewed and/or used by the Sponsor (or its respective designees) may be similar to his/her Entry. Entrant acknowledges and agrees that the Sponsor does not have now, nor shall any of them have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to Entrant’s Entry.

LIMITATION OF LIABILITY: By participating in the Contest, the Entrant agrees that Sponsor, its parent company, subsidiaries, affiliated companies, agents, retailers, advertising agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents, will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the Prize or parts thereof, if applicable, participation in the Contest or participation in any Contest-related activity, or any technical errors, printing errors, and any errors in the administration of the promotion.

Entrant agrees that the Sponsor shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of the Prize, and that Sponsor has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s computer system which is occasioned by accessing the Website or participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. In the event an insufficient number of eligible Submissions are received, or Sponsor is prevented from awarding prize(s) or continuing with the Contest as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated for any reason before the designated end date, Sponsor will (if possible) select the winners from all eligible, non-suspect Submissions received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

BY ENTERING THE CONTEST, YOU HEREBY REPRESENT AND WARRANT THAT YOU HAVE READ THESE OFFICIAL RULES AND ARE FULLY FAMILIAR WITH ITS CONTENTS. BY ENTERING THE CONTEST, YOU AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, BY STATE OR FEDERAL COURTS SITUATED IN NEW YORK, NY AND THE RIGHTS AND OBLIGATIONS OF PARTICIPANTS AND SPONSOR IN CONNECTION WITH THE CONTEST WILL BE CONSTRUED IN ACCORDANCE WITH NEW YORK LAW, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED $100, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF- POCKET EXPENSES NOT TO EXCEED $100, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

MISCELLANEOUS CONDITIONS: Failure to comply with these Official Rules may result in disqualification from the Contest. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules. Contest subject to all federal, state and local laws and regulations. If Sponsor desires to secure additional assignments for the Submission, acceptance of Prize or other documents as Sponsor may reasonably require in order to accomplish the purposes and intents of these Official Rules, then each entrant agrees to sign the same upon Sponsor’s request therefor. If a Winner fails or refuses to sign and return the acceptance forms within seven (7) days of prize notification (or a shorter time if required by exigencies), the Winner may be disqualified, and an alternate Winner may be selected.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
