Hello,

Just want to double check this relatively simple point. When two adults are jointly liable, is the LHA shared room rate applicable if they’re relevant family members, if one of them is under 35? The under 35 year old doesn’t have any children etc. The other is over 35 and has a dependent child so I’m satisfied that they’d get the 2 bed rate for their half (and possibly an apportionment argument for over 50% of the rent).

In HB, if they maintain a common household,  the over 35 year old gets the 3B rate while the under 35 year old gets the shared rate.  With a bit of good will the rent can be apportioned for HB purposes so as to maximise the combined amount.  In UC the older JT only gets the 2B rate, which reduces the max combined amount available with the most advantageous apportionment
