CLEVELAND, Ohio — A man who crept behind a man seated in a car and shot him a dozen times faces murder charges in the Jan. 3 slaying.
A Cuyahoga County grand jury charged James Davis of Cleveland with aggravated murder in the death of Demarco Millsap. Davis is not in police custody, and a warrant was issued Monday for his arrest.
The shooting happened about 11:55 p.m. in the parking lot of Lake Shore Food Mart on Lakeshore Boulevard in the city’s Collinwood neighborhood.
Millsap, 29, was sitting inside a car in the parking lot when Davis sneaked up from behind and shot him 12 times, court records say.
Davis rummaged through Millsap’s pockets and stole an unknown amount of cash before running away, according to court records.
Someone smashed into the ambulance transporting Davis from the scene to University Hospitals. The ambulance careened into another car and a utility pole.
Another ambulance picked up Millsap and drove him to the hospital, where he was pronounced dead.
A Cleveland firefighter and two EMS medics suffered minor injuries in the crash.
Davis was released from prison in February 2018 after serving a four-year sentence for felonious assault, robbery and failing to comply with a police order. He also has previous convictions for robbery and aggravated assault.
A jury convicted Millsap of being the getaway driver in a 2009 shooting that killed 17-year-old Brandon Young and injured Young’s 16-year-old brother. He taunted the victims, who were shot by another member of Millsap’s gang at the time, the Lakeshore Boyz.
