17th Judicial District Attorney's Office Files Vehicular Assault and Other Charges Against Benjamin Winters

Brighton, CO —Today, the 17th Judicial District Attorney’s Office is announcing the filing of several charges against Benjamin Winters, 24, related to his alleged actions during a traffic incident on December 7, 2023, along I-76, near mile marker 12.5, in which Commerce City Police Officers and South Adams County Firefighters were struck while investigating a separate incident. 

Winters is charged with:  
  • Vehicular Assault (DUI) (F4)
  • Vehicular Assault (Reckless) (F5)
  • 3rd-Degree Assault - First Responder (3 Counts) (M1)
Case number 2023CR003799 was filed in Adams County District Court. Winter's next court appearance is on December 13, 2023, at 1:30pm in Courtroom 4. 

The filing of a criminal charge is merely a formal accusation that an individual(s) committed a crime(s) under Colorado laws. A defendant is presumed innocent until and unless proven guilty. See Colo RPC 3.6.
