DWI Lawyer in Fair Lawn NJ

The offense of Driving While Intoxicated is considered a traffic offense in New Jersey, not a criminal offense like it is in so many other states. With that being said, the penalties for DUI in New Jersey are devastating. Provided it is a first offense DWI and the defendant’s BAC was above a .10%, the Defendant must lose their license for a minimum of seven months, serve up to 48 hours in the Intoxicated Drivers Resource Center, fined approximately $700 and potentially serve up to 30 days in the Bergen County jail. DWI offense’s in New Jersey are considered non-plea bargainable. What that means is that in order for the prosecution to deviate from the penalties mentioned above, defense counsel must provide enough material errors so that the prosecution cannot prove their case beyond a reasonable doubt. Fair Lawn NJ Issue DWI After Street Fight is Broken up

According to the Fair Lawn police, they responded to what seems like a road rage incident that turned physical during the early morning hours on Saturday. The facts are still trying to be sorted out but the Fair Lawn police were called to brawl that was occurring around 2:20 am at Orchard Street and when the dust settled they ended up putting one of the drivers involved through what is known as standardized field sobriety test. It appears that the Defendant, a thirty-nine year old Ridgewood resident must have failed the field sobriety tests because he was arrested and charged with driving while intoxicated. To make matters worse, the Defendant had to be taken to St. Joseph Medical Center to be treated for injuries suffered during the fight.

At this particular point, it does not appear that any one else has been arrested but the Fair Lawn police have stated they are still conducting an investigation and more charges may be forthcoming.
